1. Use of our Site

Eligibility: By using our Site, you represent and warrant that you are at least 21 years of age and that you possess the legal authority to enter into this agreement. You also agree to provide accurate and truthful information when creating an account or making a purchase. If you are under 21 years of age, you are not permitted to use this Site or make any purchases.

Prohibited activities include, but are not limited to: engaging in any activity that violates applicable laws or regulations; uploading or transmitting viruses, malware or other harmful code; attempting to gain unauthorized access to the Site, other accounts or connected systems; interfering with or disrupting the Site or servers; and using the Site to engage in fraud or deceptive practices.

2. Products and orders

Product descriptions: We strive to provide accurate descriptions of our products on the Site. However, we do not warrant that the descriptions, colors, information or other content available on the Site are accurate, complete, reliable, current or error-free.

Pricing: Prices for products are subject to change without notice. We reserve the right to modify or discontinue any product at any time without liability. In the event that a product is listed at an incorrect price due to an error, we reserve the right to cancel any orders placed for that product.

Order acceptance: We reserve the right to refuse or cancel any order at our sole discretion. Reasons may include product unavailability, errors in product or pricing information, suspected fraud or a shipping address in a state where our products are not permitted. ZaZilla does not ship products internationally. We only ship within the United States.

Payment: You agree to pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred. You are responsible for paying any applicable taxes related to your purchases.

3. Shipping and delivery

We will ship products in accordance with our shipping policy, which may be updated from time to time. Hemp-derived products ship where permitted by state law. Check your local laws before ordering. Shipping times are estimates and are not guaranteed. We are not responsible for delays in shipping caused by carriers, weather or other circumstances beyond our control. We do not ship products outside of the United States.

Risk of loss: All items purchased from ZaZilla are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. If your order arrives damaged, incomplete or incorrect, you must contact us on the day of delivery as described in section 4. Other order issues on direct website purchases must be reported within 7 days of delivery.

4. Returns and refunds

All sales are final. We do not offer refunds or returns unless outlined below and in our Refund policy, which this section summarises. If you have any questions before placing an order, please contact us via our contact page.

Third-party purchases: We are unable to process refunds or replacements for products purchased through retail locations or third-party websites. If you purchased a ZaZilla product outside of our official website, please contact the original place of purchase directly.

Order issues (direct purchases only): If you placed an order directly through our website and experience an issue, you must contact us within 7 days of delivery to be considered for a resolution. Requests submitted after this timeframe will not be reviewed.

Damaged, missing or incorrect items: If your order arrives damaged, incomplete or incorrect, you must contact us on the day of delivery at orders@shopzazilla.com or via our contact page. Your message must include your order number in the subject line (for example "DAMAGED ORDER #1234"), a detailed description of the issue and clear photos of the product(s), the outer packaging and the packing slip. Once received, our team will review your request. Please allow up to 5 business days for processing. Incomplete submissions may result in a denied claim.

Returns and replacements: Do not send any items back without prior approval. If a return is approved, return shipping instructions will be provided. In some cases, a prepaid label may be issued or shipping costs reimbursed. We are unable to issue replacements or resolutions without receiving and inspecting the original product.

Product disclaimer: We stand behind the quality of our products; however, individual experiences may vary. Personal results or product preference are not valid reasons for a refund.

5. Intellectual property

Ownership: All content on the Site, including text, graphics, logos, images, audio clips, video clips, software and other materials, is the property of ZaZilla or its licensors and is protected by intellectual property laws.

License: We grant you a limited, non-exclusive, non-transferable license to access and use the Site and its content for personal, non-commercial use. Any unauthorized use of the Site or its content may violate intellectual property laws and these Terms.

6. Disclaimer of warranties

The Site and all products and services provided by ZaZilla are provided "as is" and "as available", without any warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure or free of viruses or other harmful components. You assume all risk of using the Site and any products or services obtained through the Site.

These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. All products contain less than 0.3% Delta-9 THC by dry weight in accordance with the 2018 Farm Bill. Must be 21 or older to purchase. Keep out of reach of children and pets. Do not drive or operate machinery after use. Check your local laws before ordering.

7. Limitation of liability

To the fullest extent permitted by applicable law, ZaZilla and its officers, directors, employees, agents and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use or goodwill, resulting from (a) your use of the Site, (b) your purchase or use of any products or services, (c) any unauthorized access to or use of our servers and/or any personal information stored therein, (d) any interruption or cessation of transmission to or from the Site, or (e) any errors or omissions in any content on the Site.

8. Indemnification

You agree to indemnify, defend and hold harmless ZaZilla, its officers, directors, employees, agents and affiliates from and against any and all claims, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising from or related to your use of the Site, your violation of these Terms or your violation of any rights of another.

9. Governing law

These Terms and your use of the Site will be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.

10. Changes to Terms

We reserve the right to modify these Terms at any time, so please review them frequently. Changes and clarifications will take effect immediately upon their posting on the Site. Your continued use of the Site following the posting of changes to these Terms will constitute your acceptance of those changes.
